In the context of globalization and technological advancement, dynamism and creativity are pivotal factors in overcoming stagnation and promoting sustainable development. The Decree No. 73/2023/NĐ-CP dated September 29, 2023 was issued to encourage and protect officials who innovate, take creative initiatives, and are willing to assume responsibility for the common good. This article highlights several issues within Decree No. 73/2023/NĐ-CP, such as ambiguous definitions, the lack of criteria for evaluating exemptions or mitigations of liability, and the absence of mechanisms to safeguard officials from public pressure. The article recommends revising the definition of innovative officials, incorporating clearer and more quantifiable criteria, and strengthening protections for officials against the impact of public opinion and media scrutiny.
